    Aaron specialises in complex commercial disputes and insurance law. He has extensive experience acting for liability insurers in both New Zealand and Canada, advising on coverage issues and defending insured claims.  

    Aaron’s experience includes professional negligence claims, claims under public liability and bailees liability policies, claims against directors and officers by minority shareholders and investors, and claims under course of construction (“all risks”) policies. 

    Aaron has appeared regularly in various courts, including the Court of Appeal and the High Court, as well as the Court of Appeal for British Columbia and the Supreme Court of British Columbia.

    Briar has a broad base of commercial and litigation skills and acts on a diverse range of matters. Her areas of expertise include professional negligence, statutory liability, civil litigation, and all aspects of employment and health and safety.

    Briar regularly acts for employers, solicitors, architects and engineers and their indemnifiers on liability and risk management matters. She is regularly instructed to defend employers when they are faced with personal grievances and also to provide advice and guidance on best practice, risk minimisation strategies and protection of proprietary interests.

    The majority of Briar’s work is conducted in the Employment Relations Authority and High Court. She regularly represents clients at mediations and judicial settlement conferences.

    Cheryl Stuart is Head of Products and Facilities at Crombie Lockwood NZ Ltd. Her division is responsible for the development, strategy and management of facilities, products, wordings and technical advice to the company’s distribution network.

    With 30 years in the insurance industry, Cheryl’s experience encompasses broking roles in her younger days at Jardines followed by underwriting and sales appointments at NZI and Vero where in her later years she held various national management roles in product development and deployment , broker relationships, and schemes development.

    Cheryl joined Crombie Lockwood in 2010 and has been instrumental in driving an overhaul of the company’s diverse facility, affinity and scheme products. She directed the negotiation of Crombie Lockwood’s improves suite of agreed commercial wordings and successfully negotiated and developed Crombie Lockwood’s “SmartPAK” Facility to manage $150m of SME business effectively and efficiently with connectivity and market leading customer-focused products.

    Dan is a partner at Parker & Associates, a specialist litigation practice in Wellington he founded in 2001. Prior to that, he was a partner at Phillips Fox.  He has over 25 years of civil litigation experience specialising in construction and insurance litigation and other civil disputes. He acts for insurers, brokers and insured parties in claims involving many industries and professions.

    Parker & Associates is recognised as a leading firm in leaky building litigation in New Zealand and has represented hundreds of owners and defendant parties, often in complex multi-party disputes.

    The firm is also at the forefront of class action litigation in New Zealand. The firm acts for the plaintiff groups in a large product liability class action currently proceeding against cladding manufacturer James Hardie. The firm previously acted for a group of kiwifruit growers and obtained orders permitting their claim alleging negligent exercise of the Crown’s biosecurity functions to proceed as a litigation funded representative (class) action.

    Joanne Newman has been an accountant for over 33 years and is the Managing Director of Smart Business Centre Tauranga Limited and Club Accounting and Investigations Limited. Joanne is a licenced private investigator as well as an accountant. The last 20 years, Joanne has been specialising in Forensic Accounting, specifically in the area of theft of money and stock from general businesses as well as clubs.

    Joanne travels extensively throughout the country identifying theft, putting in systems in clubs and businesses and works alongside the insurance companies to assist with the assessment of loss. Joanne also works alongside the police and has appeared in court on several occasions as the expert witness for the prosecution in various theft cases.

    Monica is the Liability Claims Regional Manager at NZI. She has a Masters in Law with Distinction in Employment and Commercial Law. Prior to joining Lumley in 2006, Monica worked for eight years in private legal practice and as an in-house employment relations advisor at The Warehouse. Monica has handled a range of liability claims but has specialised largely in professional indemnity claims for construction professionals in addition to handling employment disputes matters. She has previously presented at industry conferences in the education sector and has published articles on employment law and insurance issues.

    Neil is regularly instructed by insurers on a broad range of claims, but has particular expertise in the defence of Health & Safety and Resource Management Act prosecutions. He has resolved investigations short of prosecution.  Where charges are laid he has successfully defended at trial. Where a guilty plea is appropriate, he assists clients to achieve the best outcome in those circumstances. He has dealt with several cases involving serious injury and fatalities.

    This year he successfully acted on an appeal from an Environment Court direction that a defendant disclose its insurance policy, and he will discuss the underlying focus of the Courts on insurance in sentencing for environmental offending.  He will also discuss the recent health and safety cases which address levels of fines, and calculating reparation for victims, and offer some predictions as to the impact of these decisions on business and its insurers.

    Sarah is part of the national Dispute Resolution Team at Wynn Williams, specialising in insurance law. She advises insurers on a number of areas, including material damage, liability, health and life claims, indemnity issues, and recovery actions. 

    She has a particular focus on defending PI claims and disciplinary actions, often involving real estate agents, and is known for her ability to identify the real issues in dispute and for her attention to detail without losing sight of the big picture.

    Sarah has significant experience with briefing expert witnesses for Court hearings and mediations and has appeared in the District Court, High Court and as junior counsel in the Supreme Court.  She was also seconded to a major New Zealand domestic insurer to assist with the response to the Canterbury earthquakes (opinion work, strategy and claim settlement decisions).

    After a period of 12 years working in liability claims, Stuart began his career as a dedicated liability adjuster in 1992. Following a 19-year career with a specialist UK national liability adjusting practice, he joined Cunningham Lindsey to take up the role of Complex Loss Specialist. In 2013 he transferred to Australia (Melbourne) to join the Cunningham Lindsey Major & Complex Loss Team before moving to NZ to take up an identical role.

    Throughout his career Stuart has handled serious personal injury (including fatalities and disease) and property liability claims arising from a wide spectrum of industries and from several worldwide jurisdictions. As a licensed liability adjuster to the Lloyds market he believes that he was privileged to deal with such complicated and high value claims on a 'cradle to grave' basis accompanied by being able to operate with delegated handling and financial authority.
