Webinar: Extreme Weather Events and Climate Change — Emerging Liability Risks

There is a global trend of increased extreme weather events and climate related litigation.

This impacts a wider number of product lines including Property/ISR, Professional indemnity, D&O, and the prevalence of parametric insurance products.

In this session, we will be joined by Carmen Elder and Misha Henaghan, Partners at DLA Piper, as they discuss the current impact of increased climate related litigation and potential impact to insurance in the future.

Their presentation will focus on the New Zealand and Australia position and how extreme weather events and climate related litigation has resulted in increased liability risks for corporate insureds, directors and professionals, including regulatory liability.

    Carmen Elder specialises in insurance and dispute resolution, including director and officer (D&O) liability, professional liability and indemnity advice. She has extensive experience acting for companies and insurers on managing risk, developing dispute resolution strategies and conducting litigation in a range of Courts and jurisdictions. 

     Carmen regularly acts in defence of, and advises insurers about, regulatory and civil actions against directors and officers arising from a broad spectrum of alleged contraventions. She has a particular interest in the challenges presented by the relatively recent heightened emphasis on non-financial risks and emerging risks such as climate change.

     Carmen also has deep experience acting for a broad range of professionals in the financial lines, property and construction industries, encompassing low value but strategically significant litigation, complex and high value litigation and multi-party litigation.

    Misha Henaghan is Partner at in the New Zealand office of global law firm DLA Piper. She is a civil litigator and insurance law specialist Misha regularly acts as defence and coverage counsel in the areas of property, professional indemnity, general liability, product liability, life insurance, and statutory liability.

    She has particular experience in defending professional negligence claims against engineers, architects, solicitors and accountants. She also acts for healthcare professionals, accountants, construction professionals and financial advisors in complaints (including Privacy and Human rights complaints) and disciplinary proceedings. Misha also has a particular interest in Insurtech and healthcare law.
